Hurmate Musaharah - Does it take place in this situation?

Fatwa 43791English

Question

A nine years old daughter sat on the lap of her father. For some reason her father got aroused and got erect but within few seconds orgasmed and ejaculated. During orgasm the father tightly hugged his daughter but did not do any thing else. The daughter did not understand what exactly happened. She was wearing thin clothes and her father could feel the warmth of her body. Is Hurmat-i-musaharah established?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Shariah emphasises on shame and modesty. Rasullulullah (Sallallahu Alahi Wasallam) said:

‏ (Sunnan-An-Nasa’i, Book 47, Hadith 22)

Translation: Rasullullah (Sallallahu Alahi Wasallam) said, ‘Modesty is a branch of faith.’

Translation: Rasullullah (Sallallahu Alahi Wasallam) said, ‘Modesty and belief are together.’ If one of them is removed, the other is removed."

(Sahih al-Bukhari Book 60, Hadith 150)

Translation: Rasullullah (Sallalllahu Alahi Wasallam) said, ‘One of the sayings of the prophets which the people have got is. 'If you do not feel ashamed, then do whatever you like.’

A father should be careful how he interacts with his daughter. The feminine characteristics of a girl develops between the ages of seven and nine. Girls also could attain puberty by the age of nine. She should be treated like an adult.

It is highly irresponsible for a father to treat his growing and developing daughter in the manner described in the question. The arousal and erection could lead to the prohibition of Musaharah (incest) in which his nikaah with his wife (daughters mother) could be invalidated. The father should make taubah (استغفار) for such an immoral conduct and exercise precaution in the future. Nevertheless, in the enquired situation, Hurmate Musaharah did not take place. [1]
