Do Step-children Inherit?
Question
A married man with kids marries a widow with 3 kids. If the man dies how is his inheritance divided? Between the two wives and between the kids of 1st wife vs 2nd wife?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-Salāmu ‘Alaykum Wa-Rahmatullāhi Wa-Barakātuh.
Step-children (second wife’s children) will not inherit. The two wives will share 1/8 of the estate.[1] The man’s biological children will secure the remainder. [2] However, he may make a wasiyah for the step-children.
And Allah Ta’ala Knows Best.

وأما لبنات الصلب فأحوال ثلاث: النصف للواحدة والثلثان للاثنتين فصاعدة،
ومع الابن للذكر مثل حظ الأنثيين وهو يعصبهن.
عصبة بنفسه، وعصية بغيره وعصبة مع غيره. أما العصبة بنفسه: فكل ذكر لا تدخل في نسبته إلى الميت أنثى، وهم أربعة أصناف جزءُ الميت، وأصله، وجزء أبيه، وجزء جده، الأقرب فالأقرب، يُرجحون بقرب الدرجة، أميني أولاهم بالميراث جزء المبيت أي البنون ثم بنوهم وإن سفلوا،
