Question

My husband recently passed away on the 1st August 2014. According to the English calendar my 4 months and 10 days of iddat ends on the 10th of December 2014. So I’d like to know islamically does it end on the 9th after magrib or the 10th after magrib?

Answer

Assalamu Alaikum Wa Rahmatullahi Wa Barakaatuh

In principle, the Iddah of death (the Idaah period after the death of the husband) is four months and ten days.

If the Iddah commenced on the first day of the lunar month, the Iddah of each month will be calculated based on the sighting of the moon of each month.

However, if the Iddah did not commence on the first day of the lunar month, the Iddah of each month will be calculated as thirty days and will be total of one hundred and thirty days.

And Allah Knows Best.

وإن كانت الفرقة في بعض الشهر اختلفوا فيه، قال أبو حنيفة يعتبر بالأيام فتعتد من الطلاق، وأخواته تسعين يوما، ومن الوفاة مائة، وثلاثين يوما، {بدائع الصنائع في ترتيب الشرائع، ج 3، ص 195،دار الكتب العلمية }
