SMOKING MARIJUANA IS IMPERMISSIBLE AND HARAAM
Question
Is it permissible to Smoke Ganjaa ( Daagha)?
Question posed by: Abdul Aziz Shaikh (Durban)
Answer
It is unlawful and Haraam to smoke hemp or Cannabis (Gaanja/Daagha) whether it is in small amounts or large amounts, because hemp is a narcotic substance (i.e. an intoxicant) and to use intoxicants is Haraam in Islam. It is reported in the Hadith Shareef:
Hazrat Jaabir bin Abdullah ر ضی الہ ضنہstated that the Messenger of Allah صلى الله عليه وسلمsaid: If something intoxicates in large amounts, then it is Haraam even in small amounts. (Sunan e Abi Dawood Shareef Volume 3 page number 58/ Zia-ul-Quran Publications Lahore) It is further reported in a second Hadith Shareef of Abu Dawood Shareef:
It is narrated on the authority of Hazrat Umm e Salmah ر ضی الہ ضا, she says that the Holy Prophet صلى الله عليه وسلمforbade every intoxicant and anything that causes looseness (listlessness) in the limbs.(Sunan e Abi Dawood Shareef Volume 3 page number 59 Zia-ul-Quran Publications Lahore) While explaining this Hadith Shareef Hazrat Allama Shaikh Muhaqqiq Abdul Haq Muhadith e Dehlawi یی ہ رہwrites in his authentic book "Lamãtut Tanqeeh Fee Sharh e Mishkaatil Masaabeeh:
This Hadeeth Shareef maintains that cannabis, opium and other such things like it are Haraam, the use of which would cause looseness (listlessness) in the limbs. (Lamãtut Tanqeeh Fee Sharh e Mishkaatil Masaabeeh Chapter of alcohol and the punishment of drinking it, Volume 6 page number 434 published by Daarun Nawaadir) It is stated in Miratul Manaajeeh: "Muftir" refers to something that creates heat and weakness or looseness (listlessness) in the body. (In this case) this refers to dry intoxicants, such as opium, cannabis, hashish (dry hemp leaves) etc. all these things are forbidden in
Islam. (Miratul Manaajeeh Sharh e Mishkaatul Masaabeeh Volume 5 page number 353/ Islamic publications Matiya Mahal Delhi) Huzoor Sayyidi Ala-Hazrat ر ضی الہ ضنہsays in Fataawa Razviyyah Shareef: Taking Drugs, Cannabis or opium from anywhere (i.e. no matter which place it originates from) is a major sin, absolutely. (Fataawa Razviyyah Shareef, New Edition, Volume 25 page number 205) Similarly, it is absolutely Haraam to eat or drink it for entertainment and amusement (sport etc.) or for fake pleasure or as a form of relaxation (pass time), even if it is in such a small amount that it does not cause intoxication, as it is stated in Fataawa Shaami:
The gist of the discussion is that, the use of large amounts of intoxicants is absolutely Haraam. As far as the small amounts of it is concerned, if it is for entertainment and amusement (sport etc.) or as a form of relaxation (past time) then it will also be considered Haraam. (Fataawa Shaami Volume 11 page number 913/ Zia-ul-Quran Publications Lahore) Huzoor Ala-Hazrat یی ہ رہwrites in Fataawa Razviyyah Shareef: It is absolutely impermissible to eat or take it as a form of relaxation (past time) as the common eater does so by getting addicted to it, even it does not give intoxication, or even because of it being in such a small amount it is not able to cause such an effect. Allah Almighty knows the particular (actual) intention of the eater. Some make the false excuse of using it for medicinal reasons. The Fatwa of the Mufti will not benefit such people. (Fataawa Razviyyah Shareef new addition Volume 25 page number 77) And Huzoor Sadrush-Shariah یی ہ رہwrites in Fataawa Amjadiyah in the following manner: Smoking Marijuana and Cannabis is impermissible and Haraam, because Marijuana is Muftir and Cannabis is Muskir. It is in Hadith Shareef:
The Holy Prophet صلى الله عليه وسلمforbade every intoxicant and anything that causes looseness (listlessness) in the limbs. (Fatawa Amjadiyah, Vol.3, Page 307)
In short, the conclusion is that smoking Marijuana (Gañjaa), Cannabis (etc.) is impermissible and Haraam.
