Question

Assalaamu alaikum. I have been happily married for the last 10 years and we have 3 lovely children. Last week my wife said if I eat a certain type of chocolate our marraige is over (I am on a diet). She also forced me to swear to this. I mumbled unwillingly, yes, though whispered to myself that I do not agree to this. Last night I ate one piece of that chocolate and she found out and said our Nikah is broken. Please tell me if our Nikah is broken and secondly if it is, can it be corrected. Mirza.

Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatoh

On the outset, one should realize that the issue of talaq is a grave matter and should not be taken lightly. Discussions of talaq should not be brought up for trivial matters such as dieting. The matter of Talaq is of such significance in Shari’a that it will occur even if one says it jokingly.

Abu Hurayra (Radhiyallahu Anhu) narrates that Rasulullah (Sallalahu 'Alayhi Wasallam) said, “Three things in seriousness it is serious and in joking it is serious; marriage, divorce, and taking back (the wife). (Abu Dawud, Ibn Majha)

Your wife has made you say ‘yes’ to her statement that if you eat a certain type of chocolate then the marriage is over. You mumbled the words ‘yes’ unwillingly and whispered to yourself that you do not agree with it.

Since you responded with a yes and you ate the chocolate, one talaq ba’in will take place.

The law of talaq al-ba’in is that the couple will need to re-marry in order to continue living as married couples.

Your whispering of ‘I do not agree with it’ will not affect the talaq. If a person is forced to make a condition of talaq and utters the words, it will be binding, even if he does not agree with it.
