Can I and my wife perform Salah with congregation at home?
Question
CAN WE(ME AND MY WIFE ONLY) PERFORM NAMAJ WITH JAMAT IN MY HOME?
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
Assalāmu ῾alaykum wa Rahmatullāhi Wabarakātuh
Rasulullah Sallallahu Alaihi Wassallam encouraged and emphasised that males perform their Salah with jamaat in the masjid.See the following Ahadith:
Hadith 1
Translation:
Hazrat Abu Huraira Radiallahu Anhu narrated that The Messenger of Allah Sallahu Alaihi Wasallam said: A man's prayer in congregation is twenty-some levels higher than his prayer in his house or in the marketplace. [ Ibn Majah, Hadith: 786]
Hadith 2
Translation:
Hazrat Abdullah bin `Umar Radiallahu Anhu Narrated that Allah's Messenger (ﷺ) said, "The prayer in congregation is twenty seven times superior to the prayer offered by person alone.[ Al Bukhari, Hadith: 645]
Hadith 3
Transaltion:
Hazrat Abud-Darda' Radiallahu Anhu reported,I heard the Messenger of Allah (ﷺ) saying, "If three men in a village or in the desert, make no arrangement for Salat in congregation, Satan must have certainly overcome them. So observe Salat in congregation, for the wolf eats up a solitary sheep that stays far from the flock.
[Abu Dawud, Hadith: 547]
If a person cannot perform Salah with congregation, due to some valid reason, for example, one stays far away from the masjid, or due to work schedule one misses the congregation at the masjid, he may perform Salah with his wife with jamaat at home. [1]

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنِ الأَعْمَشِ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ " صَلاَةُ الرَّجُلِ فِي جَمَاعَةٍ تَزِيدُ عَلَى صَلاَتِهِ فِي بَيْتِهِ وَصَلاَتِهِ فِي سُوقِهِ بِضْعًا وَعِشْرِينَ دَرَجَةً " .:
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، قَالَ أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ " صَلاَةُ الْجَمَاعَةِ تَفْضُلُ صَلاَةَ الْفَذِّ بِسَبْعٍ وَعِشْرِينَ دَرَجَةً ".
وعن أبي الدرداء رضي الله عنه قال: سمعت رسول الله صلى الله عليه وسلم يقول: "ما من ثلاثة في قرية ولا بدو لا تقام فيهم الصلاة إلا قد استحوذ عليهم الشيطان. فعليكم بالجماعة، فإنما يأكل الذئب من الغنم القاصية"(رواه أبو داود بإسناد حسن).
وَفِي فَتَاوَى قَاضِي خَانْ الْمَرْأَةُ إذَا صَلَّتْ مَعَ زَوْجِهَا فِي الْبَيْتِ إنْ كَانَ قَدَمُهَا بِحِذَاءِ قَدَمِ الزَّوْجِ لَا تَجُوزُ صَلَاتُهُمَا بِالْجَمَاعَةِ، وَفِي الْمُحِيطِ إذَا حَاذَتْ إمَامَهَا فَسَدَتْ صَلَاةُ الْكُلِّ، وَأَمَّا مُحَاذَاةُ الْأَمْرَدِ فَقَالَ فِي فَتْحِ الْقَدِيرِ صَرَّحَ الْكُلُّ بِعَدَمِ الْفَسَادِ إلَّا مَنْ شَذَّ وَلَا مُتَمَسَّكَ لَهُ فِي الرِّوَايَةِ كَمَا صَرَّحُوا بِهِ وَلَا فِي الدِّرَايَةِ لِتَصْرِيحِهِمْ بِأَنَّ الْفَسَادَ فِي الْمَرْأَةِ غَيْرُ مَعْلُولٍ بِعُرُوضِ الشَّهْوَةِ بَلْ هُوَ لِتَرْكِ فَرْضِ الْمَقَامِ وَلَيْسَ هَذَا فِي الصَّبِيِّ وَمَنْ تَسَاهَلَ فَعَلَّلَ بِهِ صَرَّحَ بِنَفْيِهِ فِي الصَّبِيِّ مُدَّعِيًا عَدَمَ اشْتِهَائِهِ اهـ.
وَعَلَى هَذَا فَمَا فِي مِعْرَاجِ الدِّرَايَةِ عَنْ الْمُلْتَقَطِ مِنْ أَنَّ الْأَمْرَدَ مِنْ قَرْنِهِ إلَى قَدَمِهِ عَوْرَةٌ مَبْنِيٌّ عَلَى الْقَوْلِ الشَّاذِّ الَّذِي يُلْحِقُهُ بِالْمَرْأَةِ، وَذَكَرَ الشَّارِحُ وَغَيْرُهُ أَنَّ الْمُعْتَبَرَ فِي الْمُحَاذَاةِ السَّاقُ وَالْكَعْبُ فِي الْأَصَحِّ وَبَعْضُهُمْ اعْتَبَرَ الْقَدَمَ اهـ. “و إن كان قدمها خلف قدم الزوج، إلا أنها طويلة يقع رأسها قبل رأس الرجل جاز صلاتهما” (الفتاوى التاتارخانية 2272 – مكتبة زكريا))
